Real Housewives star's divorce case heats up

The pending divorce case recently initiated by Bethenny Frankel, a star of one of the Real Housewives television franchises, continues to heat up. The latest development is that her husband Jason Hoppy has filed his own counter petition, also seeking divorce, and asserting his side of the story. While the Frankel-Hoppy divorce may not seem like something most divorcing couples in Virginia go through, it is actually quite similar. Many divorcing spouses in Virginia ask for the exact same things in the divorce and ask a lot of their children's other parents in terms of child support. So, while the amounts of money involved in this divorce might be quite high, it does provide insight into nearly every Virginia divorce, too.

Hoppy wants his wife to be ordered to pay him child support and also to have the court give him the primary custody of their two-year-old girl. In addition, he requests that his estranged wife purchase health and dental insurance for him and his daughter, as well as uncovered medical expenses for both him and the child. His filings are, in essence, a mirror image of Frankel's petition to the court filed earlier.

Virginia mom wins long international child custody dispute

A federal judge recently ruled that a father who was convicted of kidnapping his daughter and taking her out of the country must now pay his ex-wife almost $120,000 in restitution over the case. The couple married after conceiving a child in 2003 and shortly after the birth of the couple's daughter they decided to divorce. The mother, a U.S. citizen settled in Virginia with her daughter and the father visited every few weeks or months depending on what his schedule as a truck driver would allow.

In 2009, the mother agreed to let the father, a dual citizen of Iran and Canada, take their child to Iran for a few weeks so she could meet her paternal family members. Those weeks turned in months and eventually two years passed before the mother was able to win back custody of her daughter. The father tried arguing that Iranian officials prevented him and his daughter from leaving the country during his trial but he was unsuccessful.

Parents should be honest with children about divorce

Children who are in their younger years of age may have a difficult time understanding the meaning of divorce, why it is happening and what caused it to happen. Many times, when parents in Richmond do not explain divorce or the process of divorce, children will assume it is because of a negative action they have done. If this occurs, it can leave a child feeling guilty, responsible for the divorce and possibly unloved. The feelings can even affect the child through his or her entire life if the emotions are left unresolved.

Therefore, it is important for parents who are planning to divorce to be completely honest with their children about the reasons why, the process, what will happen in the future because of the divorce and that the circumstances are a part of life. Parents should try to talk to the child in a calm, caring manner that will display love and protection, and should also give the child the opportunity to ask questions.

How Facebook and social media are changing Virginia divorce

When a Virginia couple with children divorces, one reality they face is losing control over the other parent in matters concerning the children. Except in cases of abuse or neglect, one parent has no further say in how the other parent interacts with the children, including posting photographs of the children or information on Facebook and other social media sites.

While some parents may disagree with posting such material, others argue it's a good way to share photos and updates with family and friends, especially those who live far away. However, some within the family law field point out that parents should put forth efforts to be certain any pictures or information about their children should only be retrievable by intended parties and not be accessible by those not meant to see it.

International divorce requires careful planning

It is clear that divorce is not something that a Virginia resident should leap into without planning and preparation. Even if a soon-to-be ex-spouse is horrible, it is difficult to sufficiently protect your interests without working with a family law attorney and others within the divorce field. In most cases, it is better to wait and properly prepare for a divorce than to lose nearly everything for a quick and hasty break up.

When divorces go international, however, it is even more important that careful planning and preparation is taken. Since international family law issues can be much more complex than purely domestic ones, it is important that anyone in Richmond with a spouse of another nationality choose experienced family attorneys.

Reality TV star divorcing husband

Sometimes, a married couple will make the decision to get divorced. Many important issues can arise in connection to a divorce. How such issues are ultimately resolved can be very impactful.

Recently, some celebrity divorce news has arisen. The news regards reality TV star Bethenny Frankel. Frankel, 42, has starred in several reality TV programs, including "The Real Housewives of New York City" and "Bethenny Ever After." She also founded the Skinnygirl cocktail brand. It has recently been reported that Frankel and her husband are getting divorced.

Kardashian and West to be parents, but still married to Humphries

Earlier this month, many people in Virginia likely heard that Kim Kardashian and rapper Kanye West revealed are expecting their first child. Complicating the otherwise happy news is that Kardashian is still married to basketball player Kris Humphries, with whom she exchanged vows in 2011 in a highly publicized and televised ceremony.

Humphries and Kardashian have a court date set for Feb. 15 to continue working toward ending the current stalemate that is their divorce. Humphries' attorney says the wedding was a fraud and that his client wants the marriage annulled. According to reports, Kardashian wants a divorce and refuses to agree to an annulment because she thinks agreeing to one would amount to agreeing the wedding took place for publicity only. An admission like this could damage her brand and business potential -- and possibly result in claims of fraud against her for money she received in connection with the marriage.

What are some of the reasons behind divorce?

As most people in Richmond realize, there are numerous reasons as to why someone would get a divorce. In fact, there are nearly as many reasons to get a divorce as there are people actually going through the process. Choosing to end a marriage is deeply personal and one that only a couple can make, but there are some trends emerging that highlight some of the main reasons why marriages fail.

One such reason is alcohol or drug abuse. If one or both people in the relationship are engaged in substance abuse, it can be very difficult to have a normal and healthy relationship. Maybe the spouse that abuses drugs spends all of his or her time trying to get high. Maybe he or she has little or no desire to communicate because of the physical and emotional need for drugs or alcohol. Living with substance abuse may make marriage impossible.

5-time All-Star Andruw Jones faces divorce, domestic assault arrest

In the news recently is former Major League Baseball outfielder Andruw Jones, who was arrested for alleged domestic assault after his wife Nicole called police in the early morning hours of Christmas Day.

According to Jones' wife, Jones had allegedly been drinking and became violent towards her, even threatening to kill her. She fled from their Atlanta home and went to her parents' home nearby. In the meantime, Andruw Jones apparently fell asleep, and this how police say they found him when they responded to the domestic violence call.

Questions of sperm donation and child support may spell trouble

In order for some women to get pregnant, they need the assistance of a sperm donor and a fertility doctor. The shock that used to come with artificial insemination is no longer as prevalent, as more and more women in Virginia are using medical assistance to get pregnant. For these programs to work, however, there need to be crystal clear rules about what role the sperm donor can and must play in a child's life.

What if sperm donors in Virginia had to pay child support? There would likely be a dramatic decrease in the number of men who would be willing to donate sperm. In addition, being listed as the child's father and being ordered to pay child support would likely create rights for the sperm donor that the mother might not want him to have, such as visitation or custody rights. Without clear rules about these rights and responsibilities, there may be drastically fewer people who will seek medical assistance to get pregnant.

Divorce decisions can wait a week

You may have considered filing for divorce for some time, and you may feel that now is as good a time as any. Or you may have not had the peaceful and enjoyable holiday you had hoped for yet again, and feel that now is the time to end your marriage.

However, this blog post is intended to quell those anxieties amongst Virginia residents and offer the reassurance that it is okay not to file for divorce in the coming days, but instead to spend your time wisely planning for a divorce, and a division of marital property that may be inevitable.

Divorced couples can still stay in business together

Census Bureau information from 2007 shows that 3.7 million businesses throughout the country are owned by husband and wife pairs. This makes sense, considering the fact that many small businesses are family-owned and operated. But, what happens to the business when these families fall apart?

Once-married business owners face the inevitable question of whether one of them should leave the company, or if they should forge ahead and work together despite the divorce. Many people might suggest that divorced spouses should not work together, but in reality, many of them choose to -- and do it well.

Story project allows mother to see effects of divorce

So often when parents in New Kent get a divorce, the immediate focus is on establishing a stable home for the children and establishing workable visitation schedules that will minimize the emotional hardship on the children. It is no surprise that divorce is difficult for children, but sometimes the longer-term effects of divorce get less attention than what happens within the first year of a separation. For the children of divorced parents, however, life continues after that first year.

One mother has had the chance, however, to learn more about what her son went through during the first three years of her and her son's father's divorce. The participated in a joint interview as part of a national program collecting stories and interviews and the mother took the time to ask her now-12-year-old son about her divorce and how he has changed because of it.

How couples communicate may actually lead to separation, divorce

Though many people in Hanover will tell you that communication is key to a successful relationship, they forget to mention that it is a very specific kind of communication that will reinforce and foster positive relationships. Some Virginians are well-aware that the wrong kind of communication can quickly lead to separation and the end of a marriage.

First, when spouses take a win-lose approach to communication, they are setting themselves up for failure. Communication should be more about coming to agreements together, not about trying to "beat" the other spouse. A win-lose attitude is more likely to frustrate, anger and upset the spouse on the receiving end of this at-times hostile style of communication.

Why in-laws will play a role in your marriage, divorce

When two people in Richmond are getting married, they don't think their in-laws will play too much of a role in the success or failure of their marriage, but they would be wrong. A study that has followed 373 couples over the past 26 years has found that there is a correlation between close relationships with the in-laws and divorce, but the results aren't what many in Virginia may assume.

First, the study found that men who have a close relationship with their in-laws are less likely to divorce than those men with no or poor relationships with their wives' families. While this is good news, it also means that a woman's parents and relatives need to be open and receptive to their daughter's husband. When they aren't, they risk exposing her to a higher risk of divorce.

Fair property division requires honesty

When it comes down to it, dividing property in a divorce can be as easy or as difficult as the parties make it. Certainly in high-asset divorce situations in which the divorcing parties have substantial assets, the division of property will naturally be more complex than in other, more straightforward situations. However, if one or both of the divorcing parties think that they can get a better deal by hiding assets during the divorce process, this is a tactic that can come back to haunt them.

Both spouses must openly and honestly disclose all assets, income, expenses and debts. Lying or fudging details in order to avoid a fair division of property is against the law. In fact, it is illegal to hide, understate or undervalue marital property, overstate debts, report lower than actual income or higher than actual expenses in a divorce proceeding.

65,000 women lose health insurance after divorce

As Virginia women go through their divorces, they likely realize that their lives will change once their marriages are officially over. Of course, they will need to get on with less money since their former husbands' income will no longer be there, they will need to become accustomed to sharing custody of the children and either obtaining or sending monthly child support payments, but they should also consider how their health insurance coverage will change.

There is evidence that many women in Virginia and across the country are losing their health insurance within six months of divorce. In fact, over 65,000 women lose their insurance each year because of divorce. A larger number of women, 115,000, will lose health insurance coverage with a private company, but 50,000 of them are able to obtain public health insurance.

Baby Boomer divorce on the rise in the U.S.

As the Baby Boom generation is slowly getting older, American perspectives have changed. The Baby Boomers have been setting trends and expectations for the country since the boom first started and the generation's foray into gray divorce, or divorce over the age of 50, has been instrumental in redefining what it means to be a divorcé(e).

When many people in Richmond think about divorce, they think of younger couples, couples that haven't been married but five years, but there are an increasing number of Baby Boomers who are getting divorces. The longer a couple has been married, the less likely they are to get divorced, but a new study has found that the number of people 50 years or older who are getting divorced has doubled between 1990 and 2010. It is also noteworthy that during that 20-year period that the divorce rate has declined slightly. While it is true that the number of people who are older than 50 increased during the time, there were still 400,000 more gray divorces in 2010 than in 1990.

Holidays can prove tricky for newly single parents

The celebratory and often chaotic holiday season is bearing down on residents of Richmond and everyone else throughout the United States. The holiday season is a time where parents are expected to do everything possible to make joyful memories for their children. This is sometimes difficult to pull off, especially if the parents have just finalized a divorce.

While the holidays might serve as a reminder that a once-happy family is now two separate families, parents need to be conscious of their feelings and actions during this time of year so that they do not emotionally depress their children.

The pooch predicament: who gets custody of Fido?

Talk to anyone in Richmond with a pet and the overwhelming majority of pet owners will tell you that their pets are like their children. With the amount of money Virginians spend on their dogs and cats, it is quite clear that animals are well loved in the state. So, what happens to Fido and Mr. Fluffy when their owners split up?

The answer may be changing. Many states currently consider pets to be property and, thus, they will become part of the division of marital property during divorce. The wife may get the dog and the cat while the husband gets the DVD player. Moreover, if judges treat pets like property, their value is determined by the cost it would take the replace the pet, not its emotional value to an owner. So, for a mutt and a shelter cat, it is conceivable that the noncustodial spouse may not get a lot of money for his or her loss.
